Wisconsin Swine Health Rule (PRRS & PEDv)

Background

Wisconsin’s Swine Health Rule (PRRS & PEDv Rule) went into effect in 2018 and was created with input and support from swine producers and industry groups. The main goal of the rule was to control the spread and reduce the prevalence of PRRS and PEDv in Wisconsin. At the time, it was anticipated that other states would develop similar regulations; however, other states have not developed similar regulations, and this rule has placed unintended burdens on pork producers in Wisconsin and beyond.

In 2024, the Wisconsin Department of Agriculture, Trade, and Consumer Protection (DATCP) received a letter from Wisconsin Pork Association requesting that the department initiate rulemaking to repeal PRRS and PEDv swine movement rules due to the reasons mentioned above.

Timeline

February 2018– Wisconsin ATCP 10&12 Swine PRRS and PEDv rule takes effect.

June 2024– Wisconsin Pork Association submits letter to DATCP requesting to repeal the Rule.

May 8, 2025– DATCP Board opened the scope statement (ATCP 10 & 12 relating to PRRS & PEDv)

September 18, 2025– DATCP Board approved the proposed revision to ATCP 10 & 12 that would REPEAL the current testing requirements and movement restrictions related to PRRS and PEDv in Wisconsin. They also authorized the proposal for public hearing and comment. 

October 30, 2025– Public hearing pertaining to the proposed revision to ATCP 10 & 12 that would repeal the current testing requirements and movement restrictions related to PRRS and PEDv in Wisconsin.

Updates & Information

September 18, 2025

On September 18th, the DATCP Board approved the proposed revision to ATCP 10 and 12 that would REPEAL the current testing requirements and movement restrictions related to PRRS and PEDv in Wisconsin. (Link to proposed rule revision: https://datcp.wi.gov/Documents2/ATCP1012Swine.pdf).

The proposal was authorized by the Board for public hearing and comment. The hearing will be (both in person and virtual) at 9:00 a.m. on October 30, 2025, and public written comments will be accepted through November 10, 2025. The hearing information and comment information is below:
